Executive Order(EO)

A directive issued by the President that carries the force of law for the executive branch.

Overview

Executive Orders (EOs) are presidential directives that manage operations of the federal government. They can establish policies, create task forces, or direct agency actions. Many EOs directly affect federal contracting and labor requirements.

Why It Matters in GovCon

Several EOs impose obligations on federal contractors — from minimum wage (EO 14026) to paid sick leave and EEO/affirmative action. Contractors must track and comply with applicable EOs to remain eligible.

Key Details

  • Legal Basis: EOs derive from the Constitution and congressional delegations.
  • Contract Impact: FAR incorporates EOs into contract clauses where required.
  • Examples: EO 11246 (EEO), EO 13495 (Nondisplacement of Workers), EO 14026 (Minimum Wage).
  • Enforcement: Agencies and OFCCP enforce contractor compliance with EO requirements.
