Welcome to GovCon Data! These Terms of Service ("Terms") govern your access to and use of the GovCon Data website, platform, software, data, content, and related services (collectively, the "Service") provided by GovCon Data ("Company", "we", "us", or "our"). Please read these Terms carefully.
By accessing, browsing, registering for, or using the Service in any manner, you (as a visitor, registered user, or subscriber, collectively "User" or "you") acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy (incorporated herein by reference). If you do not agree with these Terms, you must not access or use the Service.
If you are using the Service on behalf of an organization or entity ("Organization"), then you are agreeing to these Terms on behalf of that Organization, and you represent and warrant that you have the authority to bind the Organization to these Terms.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service solely for your internal business purposes related to government contracting intelligence and analysis, consistent with your chosen subscription tier.

This license will automatically terminate if you violate any of these restrictions and may be terminated by us at any time. Upon terminating your viewing of these materials or upon the termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed format.

We reserve the right to modify, suspend, or discontinue the Service (or any part or content thereof) at any time with or without notice to you, and we will not be liable to you or to any third party should we exercise such rights. Features and functionalities may vary depending on your subscription tier.
To access certain features of the Service, you may be required to register for an account. When you register, you agree to provide accurate, current, and complete information and to update such information to keep it accurate, current, and complete. You are solely responsible for maintaining the confidentiality of your account credentials (such as password) and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security. We reserve the right to suspend or terminate your account if any information provided during the registration process or thereafter proves to be inaccurate, not current, or incomplete.
Access to certain features of the Service requires a paid subscription. Current subscription tiers, features, and fees are detailed on our Pricing Page. By selecting a paid subscription, you agree to pay the applicable fees.
Fees are billed in advance on a recurring basis (e.g., monthly or annually) as specified at the time of purchase. Your subscription will automatically renew at the end of each billing cycle unless you cancel it through the provided subscription management interface (e.g., Stripe Customer Portal) before the end of the current cycle. Payments are processed by our third-party payment processor (Stripe). All fees are non-refundable except as required by law or explicitly stated otherwise by us.
We reserve the right to change subscription fees upon reasonable prior notice. Any fee changes will apply to the next billing cycle following the notice.
Certain features of the Service utilize artificial intelligence ("AI") capabilities, including but not limited to proposal generation, document analysis, contract matching, and intelligent chat assistance (collectively, "AI Services"). Access to and use of AI Services is subject to the following terms:
AI Services are metered using a token-based system. Each subscription tier includes a specific allocation of AI tokens per billing period as described on our Pricing Page. Token allocations vary by subscription tier, with higher tiers receiving greater token allowances.
Users on a free trial are limited to a maximum of fifty (50) AI requests during the trial period. This limit is designed to allow evaluation of AI features while preventing abuse. Once the trial AI request limit is reached, users must upgrade to a paid subscription to continue using AI Services.
Paid subscribers may purchase additional AI tokens beyond their included allocation. Token purchases are one-time transactions processed through our payment provider (Stripe). Purchased tokens are added to your account immediately upon successful payment and remain available until used or until your subscription is terminated.
Included AI tokens (those provided as part of your subscription tier) reset at the beginning of each billing cycle. Unused included tokens do not roll over to the next billing period. Purchased tokens do not expire as long as your subscription remains active.
AI Services are intended for legitimate business use in government contracting activities. We reserve the right to suspend or limit access to AI Services if we detect patterns of abuse, automated or scripted access, or usage inconsistent with normal business operations. Excessive usage that degrades service quality for other users may result in temporary throttling or account review.
AI-generated content, including proposals, analyses, and recommendations, is provided as a starting point and should be reviewed, verified, and customized by qualified professionals before submission or use. GovCon Data does not guarantee the accuracy, completeness, or suitability of AI-generated content for any particular purpose. You are solely responsible for reviewing and validating all AI outputs before use.
The Service and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, audio, data derived from public sources, analytics generated by the Service, and the design, selection, and arrangement thereof) are owned by GovCon Data, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws. These Terms do not grant you any rights, title, or interest in or to the Service or any content on the Service, other than the limited license granted in Section 2.
If you provide us with any feedback, suggestions, or comments regarding the Service ("Feedback"), you hereby grant us a perpetual, irrevocable, worldwide, royalty-free, fully paid-up license to use and exploit such Feedback for any purpose, without any obligation or compensation to you.
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
WHILE WE STRIVE FOR ACCURACY, DATA PROVIDED THROUGH THE SERVICE IS LARGELY DERIVED FROM PUBLIC GOVERNMENT SOURCES. WE DO NOT WARRANT THE ACCURACY, COMPLETENESS, OR TIMELINESS OF THE DATA OR INFORMATION MADE AVAILABLE THROUGH THE SERVICE. YOU ACKNOWLEDGE THAT YOUR RELIANCE ON ANY SUCH INFORMATION IS AT YOUR OWN RISK.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL GOVCON DATA, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (III) ANY CONTENT OBTAINED FROM THE SERVICE; OR (IV) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.
We may terminate or suspend your access to all or part of the Service immediately, without prior notice or liability, if you breach any of these Terms. You may terminate your account and subscription at any time by following the cancellation procedures (e.g., via the Stripe Customer Portal or contacting support).
Upon termination, your right to use the Service will immediately cease. Provisions of these Terms that, by their nature, should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide reasonable notice prior to any new terms taking effect, such as by posting a notice on our website or sending an email to the address associated with your account. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms.
These Terms shall be governed and construed in accordance with the laws of the State of Nevada, United States, without regard to its conflict of law provisions.
Any disputes arising from or relating to the subject matter of these Terms shall be finally settled by arbitration in Las Vegas, Nevada, using the English language in accordance with the Arbitration Rules and Procedures of JAMS then in effect. Judgment upon the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof.
